Hi all,

What is the Family Medical Leave Act from an employee perspective? How does it protect workers?   Is it sufficient?   Why or why not?   Thoughts?

According to Cheesemen (2013), “In February 1993, Congress enacted the Family and Medical Leave Act (FMLA).   This act guarantees workers unpaid time off from work for family and medical emergencies and other specified situations”.

This law provides employees a safety net to ensure they support their family when needed. It provides an opportunity to employees to take care of their family in case they do not have any other to take care of or their presence is necessary for their welfare. If an employee needed some financial help there is other state and federal means available.

The FMLA act allows employees to take maximum of 12 weeks leaves of absence per year. It depends on the individual need but sometime 12 weeks looks short considering situation but more than 12 weeks it will be difficult for the employers to keep the position or similar position, although this applies to company that has more than 50 employees.

Under a union shop agreement, an employer may hire anyone whether he belongs to a union or not. However, an employee must join the union within a certain time period (e.g., thirty days) after being hired. Union shops are lawful.
Agency shop: A workplace in which an employee does not have to join the union but must pay an agency fee to the union.   Under an agency shop agreement, an employer may hire anyone whether she belongs to a union or not.
