US, Canada and the European Communities complained in 1995 that spirits exported to Japan were discriminated against under the Japanese liquor tax system which, in their view, levies a substantially lower tax on “shochu” than on whisky, cognac and white spirits.
The Panel came to the conclusion that by taxing vodka more than shochu, Japan is in violation of its obligations. Furthermore, the Panel discovered that shochu and liqueurs are competitive or substitutive goods, and Japan, by using dissimilar tax measures, violated its responsibility. Consequently, Japan is being held accountable and was given instructions to bring the liquor tax in compliance with GATT 1994.
